Paul E. Riffel Tampa Estate Planning Attorney

A few more reasons to get a will

If you have minor children, there are three very important reasons to have a will. First is to nominate someone to be the guardian of your children. Without your input, the court will appoint a guardian based upon certain legal standards.

Second, you need to ensure the children do not get all of the estate at age 18. That is simply too young of an age. Instead, you can set up a Testamentary Trust within your will so that the child can be taken care of until a later age.

Third, if you are divorced, your ex-spouse may be able to take over your entire estate because that person will be the natural guardian of your beneficiary. As such, your ex-spouse would then control the distribution of all of your assets unless you have a will. Do not delay in getting this important task completed.
