Collaborative law

Collaborative law is a new way to handle a divorce case in a non-adversary manner. Recently, our circuit in Hillsborough County adopted a rule outlining this new process.

Basically, the parties try to settle their divorce case using attorneys and other experts outside the courtroom. One key factor is that the attorneys must agree to withdraw from the case if an agreement cannot be reached. This gives an incentive to the attorneys to settle rather than to litigate the case.

Although Collaborative law is fairly new to our circuit, it has been around for many years in other parts of the country. I personally believe no one can draft a better Settlement Agreement other than the parties. To let a stranger decide key issues, such as time-sharing and the like, is simply not prudent.
