Why is mediation important in a divorce?

Mediation is required in divorce, but why is it important?

Mediation is highly successful and should be used in good faith. No one is in a better position to settle his or her case than the parties themselves. Therefore, mediation is a very important aspect of the case.

Even if a total agreement cannot be reached, it is in the parties’ best interest to reach a partial settlement so that only those issues that the parties cannot resolve are referred to the judge.

Mediation should also be used to scope out the other party’s position on the various issues. You need to listen carefully during mediation to find out what the arguments are with regard to each of these issues.
